These Terms and Conditions of Service ("Terms") govern the purchase of all products from Cruss Pair Ltd via our online storefront. By placing an order (including pre-orders), you ("the Customer," "the Buyer," or "you") agree to be bound by these Terms.
Platform: Catali Web Stores ("the Infrastructure Provider")
Cruss Pair operates a limited-release "Capsule Drop" model. Many items are offered on a pre-order basis to ensure production allocation for our community.
1.1. Billing and Allocation: Customers are billed the full purchase price immediately at the time of checkout via our third-party Payment Service Providers (Paystack or Flutterwave).
1.2. Production Timeline: Pre-ordered items have an estimated fulfillment window of four to six (4–6) weeks before shipment. This timeline is an estimate and not a strictly binding deadline.
1.3. Production Allocation Fee: Because our products are produced in limited batches based on confirmed orders, cancellations of pre-orders prior to shipment are subject to an 8% Production Allocation Fee. This fee covers non-recoverable transaction processing costs and the administrative loss of inventory allocation.
1.4. Delayed Fulfillment Rights: If shipment does not occur within fifteen (15) days beyond the estimated six-week dispatch window (a total of 57 days from the order date), the Customer may request a cancellation without incurring the Production Allocation Fee. All cancellation requests must be submitted in writing to our official support channel before the shipment confirmation is generated.
2.1. Fixed Pricing: We maintain fixed prices for each accepted currency. The default currency for domestic orders within Nigeria is NGN. All international orders are billed in USD.
2.2. Currency Selection: The applicable currency is determined by the destination shipping address or the Customer's selection at checkout. We do not perform dynamic currency conversion, and we are not responsible for any additional bank fees or conversion discrepancies imposed by the Customer's financial institution.
3.1. Risk Transfer: Ownership and the risk of loss or damage to the goods transfer to the Buyer at the moment the parcel is accepted by the courier (e.g., DHL, FedEx, or domestic partners).
3.2. Lost in Transit: While the risk of loss sits with the Buyer, Cruss Pair will assist in filing claims for shipments confirmed as lost by the courier. Any replacement or store credit offered in such cases is at our sole discretion.
3.3. International Duties and Taxes: For all international (USD) shipments, the Buyer is the "Importer of Record" and is solely responsible for all customs duties, import taxes, and clearance fees imposed by the destination country.
3.4. Abandonment of Goods: If a Buyer refuses to pay customs fees and the shipment is subsequently returned, abandoned, or destroyed by authorities, the order will be considered fulfilled. In such events, the Customer will be eligible for Store Credit Only, minus the original shipping costs and any return penalties incurred by the Company.
4.1. Exchanges Only Policy: Due to the limited nature of our drops, Cruss Pair offers Exchanges Only. We do not offer cash refunds for change-of-mind, fitment issues (unless the wrong size was sent by us), or order remorse.
4.2. Exchange Window: Requests for exchange must be initiated within thirty (30) days of the recorded delivery date.

4.4. Defective Goods: Notwithstanding the "Exchanges Only" policy, we acknowledge mandatory consumer rights regarding manufacturing defects. If a product is proven to have arrived with a manufacturing defect, the Customer is entitled to a repair, replacement, or refund at our discretion, as required by applicable law.
4.5. Final Sale: Limited releases, promotional items, and specific "Drop" products marked as "Final Sale" are ineligible for exchange.

Any unauthorized reproduction, imitation, or commercial distribution of these materials is strictly prohibited and will be met with legal action.
6.1. Independent Operation: Cruss Pair is an independent business entity. The website and e-commerce infrastructure are provided by Catali Web Stores ("Catali").
6.2. Indemnification of Catali: Catali acts solely as a technology provider and is not the seller of the products. You agree to indemnify, defend, and hold Catali harmless from any claims, losses, or disputes arising out of your transaction with Cruss Pair Ltd, including but not limited to product quality, shipping delays, or business disputes. Catali has no liability for the fulfillment of orders or the processing of refunds and exchanges.
To maintain the integrity of our community drops, we prohibit the use of automated software (bots) to purchase inventory. We reserve the right to cancel any order that we, in our sole discretion, believe was placed for the purpose of commercial resale or through unfair technical means.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms that cannot be resolved through mutual mediation shall be subject to the exclusive jurisdiction of the courts in Lagos, Nigeria.
